understand by the quote “The American Constitution was the scourge of the underclass…” that the United States Constitution was used to punish and neglect the rights of Black Americans. The Constitutions was only in favor of White-rich men of the society during the first 150 years of the Constitution.
Frankfurter among other justices was considered as one of the justices “who increased and strengthened the role of the federal government” because his ideas about the laws were very straightforward against overturn some laws and unconstitutional (160). He even reminded state legislatures that they were responsible of the preservation of liberties (162).
Frankfurter agreed with in Brandeis’ theory about the “notion building”. He was very in favor on the notion of construction and development, such was his enthusiasm that he worked with Brandeis to develop his theory (163).
Frankfurter considered “constructing statutes” as interpreting laws (163).
I think judges should be elected because in that way people would elect the candidates for their trajectory as judges and for their view and interpretation of the law, instead of who the president wants in the Supreme Court. Judges election will eliminate bias and political favoritism and favors.
